Balance is due before boarding the cruise, on ___________________, and must be made by credit card, cash, or certified check.
 
 
For the purposes of this contract, the Venture Cruise Line is henceforth the Venture. The person(s) signing this contract and making the initial deposit is/are the Host. The guests of the Host are henceforth guests.
 
General Rules
      MAXIMUM CAPACITY is 100 people including hosts, guests, and party staff.
      BOARDING & DEPARTURE & RETURN is from Clam Hut & Bar Restaurant, 1 Atlantic Street, Highlands, NJ 07732 unless otherwise specified. Boarding (and set up) is permitted one half-hour before departure time. All guests must exit immediately upon return to port.
      WHEELCHAIR USERS can be accommodated on the lower deck only. The Venture suggests guests bring a hat, light jacket/sweater, sunglasses, and comfortable shoes.
      Smoking is only permitted in the designated area. See the crew for clarification.
      SECURITY SCREENING upon boarding is appropriate as per the U.S. Coast Guard maritime security requirements. This might include screening of every guest/host and each purse, bag or container. [Section 89 of Title 14 of the United States Code authorizes the COAST GUARD TO BOARD VESSELS subject to the jurisdiction of the U.S., anytime upon the high seas and upon waters over which the United States has jurisdiction, to make inquiries, examinations, inspections, searches, seizures and arrests.]
      The Captain ALWAYS has to right to CUT OFF ALCOHOL CONSUMPTION to one or all guests/hosts (for inappropriate or dangerous behavior). The Captain may CONFISCATE illegal substances, fireworks, sparklers, and other contraband. Any guest/host found with an illegal substance will be turned in to the appropriate legal authorities and the Captain has the right to end the cruise immediately if this action is appropriate. The Captain has the right to exclude or eject all persons from the function for inappropriate behavior.
      The Venture agrees to allow the host to enter into a contract for music or other forms of entertainment or other services in moderation in conjunction with this function, after obtaining prior written consent of the Venture.
 
Damages and Cancellations
      In the event of breach of the agreement by the Host, the Venture reserves the right to cancel same without notice and without liability to the Venture. The amount deposited by the host for use of space shall be retained by the Venture as liquidated damages, but this shall not preclude the Venture from recovering any additional damages sustained, including attorney's fees and costs, for example, by reasons of any breach hereof.
      The Host assumes the responsibility for all damages caused by host/guests (including any other persons attending the function or under separate contract with the Host).
      A security deposit would be used for MINOR DAMAGE AND CLEAN UP. If damage and cleanup requires more than this amount, the host is liable and is also liable for the Venture's legal fees and court costs required to recover damages.
      This agreement is contingent upon the ability of the Venture to perform the same, and is subject to strikes, labor disputes, accidents or other causes beyond its control, and in any such event the Venture shall not be liable beyond the amount paid for in the use of space herein reserved. If the space reserved herein cannot be made available to the host, the Venture reserves the right to substitute similar or comparable accommodations for function which substitution shall be deemed by the host as full performance under the agreement.
      The Host hereby waves trial by jury in any litigation arising out of or in any way connected with this agreement or any breach hereof.
      In the event that this agreement is signed In the name of a corporation, partnership, association, club or society the person signing such contract represents to the Venture that he or she has full authority to sign such contact, and that in the event that he or she is not authorized, he/she will be personally liable for the full performance of the contract
      Host shall deposit one-half (1/2) of total contract price upon execution of this contract by host. SAID DEPOSIT SHALL BE NONREFUNDABLE. Any changes made thereafter shall not be binding on Venture unless host pays the Venture the full price for all charges made after this period. Host shall pay the balance of the total contract price before boarding the Venture for the contracted voyage, based on the "guaranteed count." Such payment shall be by cash, credit card or certified check. Additional charges for additional guests over and above the guaranteed head count are payable at the time of the function and possible only if the total head count for the sail does not exceed 100 people.
      The Host agrees the Venture assumes no responsibility for loss of guests' or hosts' personal property.
      The prices herein are subject to increase because of Increases in sales lax.
      There are NO REFUNDS.
      Should fog cause the vessel to remain at the dock for the scheduled cruise time, guests/hosts may board and disembark as contracted, but the vessel will remain at the dock. The contract remains intact.
      Rain is not a reason for cruise cancellation.
      Thunder storms may cause a delayed in boarding, but not necessarily a cancellation of cruise.
      Should extreme high winds cause a cancelled cruise the Host may reschedule the sail at a later date at no additional cost.
      Should a life-threatening situation exist, whether aboard ship or not, the Captain shall make the final determination regarding cruise operations.
